Terms of Service

1. Agreement

FITTS is a facial-analysis studio operated by Ten Year, LLC, a Delaware limited liability company doing business as FITTS (“FITTS,” “we,” “us”). By creating an account or using the service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use FITTS.

3. The service

FITTS produces a reading of your facial architecture from photographs you provide, and generates commissioned, styled looks based on that reading. The service offers aesthetic and styling guidance only. It is not medical, dermatological, surgical, or psychological advice, and no part of the service diagnoses, treats, or evaluates any condition. Results are interpretive, vary from person to person, and are not guaranteed to please.

4. Credits and payment

  • The studio runs on prepaid credits. Credits are priced in U.S. dollars at the rate shown at purchase, charged through Stripe, our payment processor.
  • Prices exclude sales tax. Where tax applies, it is calculated from your billing address and shown before you pay.
  • Credits do not expire, but they are not transferable, hold no cash value, and cannot be redeemed for money except where the law requires it.
  • We may change credit pricing prospectively; changes never affect credits you already hold.

5. Commissions and refunds

Looks are produced on commission: when you commit a commission, the credits for it are spent and the work is generated for you alone. Because each look is bespoke, credits spent on a successfully generated look are not refundable — taste is yours to judge, but the work has been done.

If a generation fails for technical reasons, the credits for the failed work are refunded to your balance automatically. Purchases of credits themselves are final, except where consumer-protection law gives you a non-waivable right. For anything that feels wrong, write to support@fitts.studio — we would rather fix it than argue about it.

6. Your content

  • You keep all rights to the photographs you upload. You grant us a limited license to host and process them solely to provide the service, as described in the Privacy Policy.
  • You may upload only photographs of yourself, or of someone who has given you their informed consent.
  • Generated looks are licensed to you for personal, non-commercial use.

7. Acceptable use

Do not use the service unlawfully; do not upload photographs of others without consent; do not attempt to identify, surveil, or evaluate third parties; do not probe, scrape, reverse engineer, or resell the service. We may suspend or terminate accounts that violate these terms.

8. Intellectual property

The service — including its software, analysis methods, design, and content other than yours — belongs to Ten Year, LLC and its licensors. These terms grant you use of the service, not ownership of any of it.

9. Disclaimers and limitation of liability

The service is provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent the law allows, Ten Year, LLC will not be liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to the service is limited to the greater of fifty dollars ($50) or the amounts you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Termination

You may close your account at any time from settings. We may suspend or terminate the service or your account for breach of these terms. Sections 6, 8, 9, and 11 survive termination.

11. Governing law

These terms are governed by the laws of the State of West Virginia, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Kanawha County, West Virginia, and you consent to their jurisdiction.

12. Changes

We may update these terms; the current version will always live at this address with its effective date. Material changes will be announced by email or in the app before they take effect, and continued use after that constitutes acceptance.
